1. Initial provisions and company information
1.1. These Terms and Conditions (“Terms”) govern the use of the website thisisbadreputation.com (the “Website”), as well as the legal relationship between CREATIVE ONLINE ACTIVITIES SRL (the “Company” or the “Seller”), as operator of the Website and seller, and the person who uses the Website or enters into a distance sales contract (the “Customer”).

1.3. The Company is established and operates under Romanian law and conducts e-commerce activities with delivery in Romania, with possible future expansion within the European Union.
2. Scope and acceptance of the Terms
2.1. By accessing the Website, creating an account, or placing an order, the Customer confirms that they have read, understood, and fully accepted these Terms.
2.2. If the Customer does not agree with the Terms, they must not use the Website and must not place orders.
2.3. The Terms apply to all distance sales contracts concluded through the Website.
3. Products and description
3.1. The Website sells niche luxury fragrances intended for personal use.
3.2. The Seller makes reasonable efforts to ensure the accuracy of product descriptions, images, and specifications.
3.3. Minor variations in packaging or olfactory perception may occur due to production batches, digital display, or individual subjective perception.
4. Prices and VAT
4.1. All prices displayed on the Website include VAT applicable in Romania at the time of order placement.
4.2. Prices may be changed without prior notice; however, such changes do not affect already confirmed orders.
5. Currency
5.1. For orders delivered in Romania, payments are processed in RON.
6. Payment methods
6.1. Available payment methods are:
a) bank card (secure processing)
b) cash on delivery (COD), available only within Romania
6.2. Payment is considered completed upon transaction authorization or acceptance of COD.
7. Order processing and confirmation
7.1. An order is confirmed upon payment authorization or COD acceptance.
7.2. The Seller reserves the right to refuse or cancel orders in cases of product unavailability, technical error, or suspicion of fraud.
7.3. The Customer will be informed accordingly.
8. Delivery
8.1. Products are shipped from Romania to customers located in Romania.
8.2. Estimated delivery time is 1–3 working days via third-party courier services.
8.3. Tracking information is provided after dispatch.
8.4. Deliveries to other EU countries may be subject to separate conditions.
9. Transfer of risk
9.1. Risk in the products transfers to the Customer upon delivery to the address provided.
9.2. Transport-related issues are handled in accordance with applicable consumer law.
10. Right of withdrawal and returns
10.1. The Customer benefits from the statutory 14-day withdrawal right, subject to legal exceptions.
10.2. Fragrance products may be returned only if they remain sealed, unopened, and unused.
10.3. Fragrances that are unsealed, opened, sprayed, or tested are considered used and cannot be returned for hygiene and health-protection reasons.
11. Return procedure
11.1. The Customer must notify withdrawal within 14 days from delivery.
11.2. The product must be returned sealed and unused to the communicated return address.
11.3. Return shipping costs are borne by the Customer unless otherwise specified.
11.4. Refunds are issued within 14 days after return acceptance, via the original payment method.
12. Warranty and conformity
12.1. Products benefit from the legal conformity warranty under EU and Romanian law.
12.2. The warranty applies to defects existing at delivery.
12.3. Subjective dissatisfaction regarding scent or performance does not constitute non-conformity.
